At the outbreak of the Civil War, though not yet 17 years old, he went to Virginia as acting third lieutenant in the 5th Regiment of the North Carolina Infantry; returning to Georgia in October 1861, he failed in his effort to secure a lieutenancy, and on 1 May 1862, he enlisted as a private in the Richmond Hussars (Cavalry Company A, Cobb’s Legion of Georgia Volunteers). On 10 February 1863, he was elected captain of the Richmond Dragoons (Cavalry Company K, Cobb’s Legion of Georgia Volunteers), also known as Captain Eve’s Company of Cavalry. By November 1864 he was Captain of Cavalry Company K, Phillip’s Legion of Georgia Volunteers. According to his sister, Eva Berrien Eve, he was "the merriest young captain in Virginia” whose ‘happy, gleesome letters” were "written in the offhand nonchalant spirit of a gay boy cavalier.” After the War he married and settled on his large plantation ten miles southwest of Augusta. In 1877 he became junior partner of his brother-in-law, Charles Colcock Jones, Jr. in the law firm of Jones & Eve.
